General Terms and Conditions

§ 1 Scope and Provider

(1) These General Terms and Conditions apply to all orders placed by consumers and businesses through the LoveLEDlights online shop.

(2) The provider and contractual partner is:

(3) A consumer is any natural person who concludes a legal transaction for purposes that are predominantly neither commercial nor self-employed. An entrepreneur is a natural or legal person or a legal partnership that acts in the exercise of its commercial or self-employed professional activity when concluding a legal transaction.

(4) These General Terms and Conditions apply exclusively. Deviating conditions of the customer will not be recognized unless the provider expressly agrees to their validity in writing.

§ 2 Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer, but a non-binding invitation to order.

(2) By clicking the order button, you place a binding order for the goods contained in the shopping cart. The receipt of the order will be confirmed immediately by email. This confirmation of receipt does not yet constitute acceptance of the order.

(3) The contract is concluded as soon as the provider accepts the order through a separate order or shipping confirmation or ships the goods.

(4) For custom-made items as defined in § 3 (2), the contract is only concluded once you have expressly approved the design proposal we provide.

(5) The contract language is German.

§ 3 Made-to-Order Production and Custom-Made Items

(1) All neon signs are handcrafted after the order is received. Signs from our standard and catalogue range are nevertheless not custom-made items within the meaning of § 312g (2) No. 1 BGB (German Civil Code). The statutory right of withdrawal applies to them without restriction, even though they are only produced once ordered.

(2) A custom-made item only exists where the sign is designed according to the customer's individual specifications or is clearly tailored to their personal needs. This is the case in particular for customer-supplied texts, names, logos or motifs, as well as for dimensions or colour combinations that deviate from the standard range.

(3) For custom-made items, you will receive a design proposal for approval before production begins. Production only starts after your express approval.

(4) Minor, production-related deviations in colour, brightness or size are possible and do not constitute a defect.

§ 4 Prices and Shipping Costs

(1) All prices are final prices and include statutory VAT.

(2) The price stated in the online shop at the time of the order applies. For custom-made items, the price communicated to you with the design proposal and approved by you applies.

(3) Shipping is free for the customer.

§ 5 Payment Terms

(1) The following payment methods are available in the online shop:

  • Credit card (Visa, Mastercard)
  • Maestro
  • Apple Pay
  • PayPal
  • Klarna
  • TWINT
  • USDC (Stablecoin)

Which payment methods are available in individual cases depends on the chosen delivery country and the ordered products and will be displayed during the ordering process.

(2) Payment is due immediately upon conclusion of the contract, unless otherwise agreed.

(3) In case of default of payment, the statutory provisions apply.

§ 6 Delivery and Delivery Time

(1) Delivery will be made to the delivery address specified by the customer.

(2) Since each sign is only produced after the order is received, the delivery time is usually 6–14 days (production plus shipping), depending on the design and size. Specific shipping times per country are listed on our shipping page.

(3) For custom-made items, production only begins once you have approved the design proposal. The delivery time is extended accordingly by the duration of the design phase.

(4) Delays due to circumstances beyond the provider's control (e.g. force majeure, delays by shipping service providers) will extend the delivery time accordingly.

§ 7 Retention of Title

The delivered goods remain the property of the provider until full payment.

§ 8 Right of Withdrawal and Voluntary Right of Return

(1) Consumers have a statutory right of withdrawal. The details can be found in the separate cancellation policy.

(2) For all products from our standard and catalogue range, the statutory right of withdrawal applies without restriction – even if they are only manufactured after the order is received.

(3) Only for custom-made items as defined in § 3 (2) is there no statutory right of withdrawal pursuant to § 312g (2) No. 1 BGB, as these are produced according to your individual specifications.

(4) In addition to the statutory right of withdrawal, we grant you a voluntary right of return of 14 days from receipt of the shipment for products from our standard and catalogue range. The prerequisite is that the goods are undamaged and in perfect condition. The direct costs of return shall be borne by the buyer. To arrange a return, please contact our support in advance at support@loveledlights.com. This voluntary right of return does not affect your statutory rights.

(5) The voluntary right of return under paragraph 4 does not apply to custom-made items as defined in § 3 (2). Such signs are produced specifically to your specifications and cannot be reused. So that you can still order with confidence, you will receive a design proposal for approval before production begins. Your statutory rights in the event of defects remain unaffected.

§ 9 Warranty / Liability for Defects

(1) The statutory provisions on liability for defects apply.

(2) In case of a defect in the goods, please contact us using the contact details provided above.

§ 10 Liability

(1) The provider is liable without limitation for damages resulting from injury to life, body, or health, as well as for damages based on intent or gross negligence.

(2) In the event of slightly negligent breaches of essential contractual obligations (cardinal obligations), liability is limited to the foreseeable damage typical for the contract. Otherwise, liability for slight negligence is excluded.

(3) Liability under the Product Liability Act remains unaffected.

§ 11 Dispute Resolution

We are not willing or obliged to participate in dispute resolution proceedings before a consumer arbitration board.

§ 12 Final Provisions

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory consumer protection provisions of the state in which the consumer has their habitual residence remain unaffected.

(2) Should individual provisions of these General Terms and Conditions be or become ineffective, the validity of the remaining provisions shall remain unaffected.
